All services provided in the context of standard training at the itc. training center and on customers' site (customer specific on-site training) as well as customer-specific training at the itc. training center are subject to the present Terms and Conditions of the itc. Training & Consulting GmbH (in the following called itc.). The registration is subject to the acceptance of the present terms and conditions.

Registration for a training course can be submitted by mail, fax, e-mail or online registration. The customer/participant shall receive a written confirmation based on the present terms and conditions.
The customers'/participants' data is electronically stored for the purpose of order handling. It is processed for internal purposes only.

3.1 Course fees

The course fees include the participation fee for one person (provided that nothing else was agreed) and are without statutory VAT. In general, the course fees shall include the following services:

The course fee shall include a certified trainer, use of the IT training infrastructure, training materials and certificates.

There will be no refund of the course fee, either in whole or in part, should the participant fail to attend course hours or days.

3.2 Cancellation by the customer/participant

Customer may cancel its registration for any course at no charge provided that written notice of cancellation is received by itc. at least 14 days prior to the date of the course. 50% of the price shall be charged where notice of the cancellation is received less than 14 days prior to the date of the course. The full price of the course shall be charged where no notice of cancellation is received by itc.

The paid course fee shall be offset against the course fee for the same training taking place within the course of three months.

3.3 Cancellation of a course by itc. Training & Consulting GmbH

If itc. has to cancel or postpone a course, especially in the case of too low enrollment, the course participants will be informed at least 7 calendar days before the Course starts.

No other claims of the customer/participant will be accepted in case of a cancellation of the course on due time by itc.

3.4 Modification

itc. reserves the right to change content and training documents as well as duration and fees for standard courses.

According to customer request customer-specific training takes place at the itc. training center or on customers' site. This type of training is subject to a particular training agreement.

4.1 Course fees

The individually agreed fees for customer-specific courses taking place on customers' site or at the itc. Training Center are without statutory VAT and additional costs for trainers (see services price list).

There will be no refund of the course fee, either in whole or in part, should customer participants fail to attend the complete training course.

4.2 Cancellation of the course by the customer

Customer may cancel an agreed customer-specific training taking place on customers' site or at the itc. Training Center at no charge provided that written notice of cancellation is received by itc. at least 14 days prior to the date of the course.

100 % of the agreed price (plus VAT) shall be charged where notice of the cancellation is received less than 14 days prior to the date of the course.

The course fee of standard training will be invoiced at course start and the fee of customer specific training on the customers' site or at the itc. training center will be invoiced after the end of the course, provided that nothing else has been agreed. Invoices are payable immediately due net.

The courses start on the first day at 10.00 a.m. and on the subsequent days at 09:00 a.m. From Monday til Thursday the courses finish at 05.00 p.m. On Friday the course ends at 03:00 p.m..

Deviations will be communicated in due time.

All training documents include proprietary information. All rights reserved by Infor/Baan or itc. No part of the training documents may be reproduced, stored in a retrieval system, or transmitted in any way or by any means, including, without limitation, photocopying or recording. Under no circumstances may the whole or any part of a software provided in the context of training delivery be copied.

itc. shall not be liable for ensuring that products, procedures and other data mentioned in the course program are free from third-party rights.

itc. shall be liable for any damages committed deliberately or as a result of gross negligence. Damages resulting from slight negligence are subject to the following terms:

In the event of any essential breach of contract, the liability of itc. shall be limited to direct damages that were reasonably foreseeable by itc. at the time of contract conclusion.

In the event of any financial loss, for example resulting from loss of production or loss of profit, the liability of itc. shall be limited by the principles of good faith, for example in the case of disproportionality between the compensation amount and the damage value.

Any further liability of itc. shall be excluded. If a participant brings his own software and files these elements may only be used in accordance with the trainer. In the event of any infringement of this term itc. reserves the right to claim compensation for damages.

A potential liability of itc. for the lack of agreed features or in accordance with the Product Liability Act remains unaffected.

No amendment shall be effective unless agreed in writing.
Place of Performance is the agreed training venue
The agreement shall be governed by and construed in accordance with laws of the Federal Republic of Germany

Place of Jurisdiction for the resolution of all disputes shall be the domicile of itc. Training & Consulting GmbH, provided that the customer is a registered trader.
The present General Terms and Conditions for training course delivery replace all previous versions.
